Orbitomo Terms of Use

These Terms of Use set the conditions for using Orbitomo and the rules for enjoying the card-collection experience safely.

1. About Orbitomo

Orbitomo is a card-collection game where users collect Tomo Cards, Spot Cards, Venue Cards, Tomo Eggs, and related items. The Feed available after a card exchange is limited to eligible exchange relationships.

Orbitomo is not designed for exchanging contact details, finding people to meet, dating, private messaging, public user search, or sharing users' current locations with one another.

By using Orbitomo, a user agrees to these Terms and the Privacy Policy.

2. Age Requirements

• Feed, Tomo Egg AI creation, Tomo Card free text, and other age-restricted features are not provided to users under 13.
• Users aged 13 through 17 should review these Terms with a parent or legal guardian when appropriate.
• Additional review and posting limits may apply based on age.
• Tomo Card free text is available only to users aged 18 or older who have completed the required email verification.
• Users must not bypass age, email, guardian, suspension, or safety restrictions.

3. Account Security

Users are responsible for taking reasonable care of their device, account, My ID, verification codes, email address, and account recovery information.

My ID, verification codes, and information used to confirm an account with support should not be made public outside the places where the app asks for them. Contact support promptly if unauthorized use is suspected.

4. Safe Use And Prohibited Conduct

When using Orbitomo, users must follow surrounding conditions, traffic rules, facility rules, applicable law, and the rights of others.

The following conduct is prohibited:

• Entering private property, restricted areas, dangerous places, or places where entry is not permitted
• Focusing on the screen while driving, walking in unsafe conditions, in crowds, or whenever attention to the surroundings is required
• Dangerous behavior, nuisance, disruption of a facility, or interference with nearby residents
• Harassment, stalking, waiting for another person, threats, discrimination, bullying, or impersonation
• Posting or requesting phone numbers, email addresses, home addresses, school or workplace details, external account names, or arrangements to meet
• Location spoofing, modified apps, automated operation, unauthorized collection, or abuse of multiple accounts
• Submitting another person's personal information, confidential information, illegal or dangerous content, or content that infringes another person's rights
• Using Orbitomo to track people, share current locations, search for people publicly, match or date, or discover nearby users

5. Location, Bluetooth, And Notifications

Location is used for outing mode, card collection, encounter decisions, Spot Card and Venue Card collection, and nearby card hints. Orbitomo does not show a general user's exact current location, movement history, or exact encounter place or time to other users.

Bluetooth is used to confirm proximity for card exchanges. Entering a My ID by itself does not complete an exchange; an exchange is recorded only after the mutual confirmation required by the app is complete.

Notifications do not display another user's exact location or time, or information used to administer a device or account.

6. Feed, Posts, And Media

Feed is a card-status feature whose audience is limited by Tomo Card exchange relationships. It is not a public timeline, private messaging service, friend-request system, follower network, ranking system, or nearby-user search.

Posts, replies, images, videos, Tomo Card free text, nicknames, character names, AI creation text, and support messages must not include:

• Legal names, personal face photos, home addresses, phone numbers, email addresses, school or workplace details, or exact current locations
• Requests to exchange contact details, arrangements to meet, invitations to external services, or requests for private contact
• Sexual content, content inappropriate for minors, violence, discrimination, hate, bullying, or harassment
• Self-harm, dangerous or illegal acts, drugs, fraud, or impersonation
• Material that infringes copyright, trademark, portrait, or other third-party rights

For safety, Orbitomo may review content before or after publication, respond to reports and blocks, hide or delete content, restrict features, or suspend accounts. Orbitomo does not guarantee an individual response or action for every post, report, or request.

7. Spot Cards And Venue Cards

Spot Cards and Venue Cards may display the name, description, image, category, public-place location, review status, and ended status of a shop, facility, event venue, or other public place. This information does not represent a general user's current location or visit history.

A “reviewed” label means that Orbitomo reviewed the submitted card information. It does not guarantee the venue's operating status, accuracy, safety, legality, or continued availability.

Before visiting a place, users must independently check opening hours, entry conditions, crowding, facility guidance, surrounding safety, and applicable law. A map display, collection range, proximity hint, or public image is not permission or encouragement to enter a dangerous or restricted area.

Orbitomo may hide, suspend, delete, or mark a public card as ended because of safety, rights infringement, legal requirements, venue circumstances, changes to submitted information, or the end of a publication period.

8. Sharing Outside The App

Sharing outside Orbitomo occurs only when a user explicitly uses the iOS share sheet or another device sharing feature. Orbitomo does not automatically post to an external service on a user's behalf.

An eligible card or non-empty weekly/monthly album can have a safe share image and an expiring public page. A page expires 30 days after creation and can be revoked earlier. Sharing again creates a new page instead of extending an old page.

Shared content includes game information such as card artwork, card type, rarity, acquisition date, and album period. A shared Tomo Card image includes the nickname, character name, Tomo Egg appearance, selected fixed phrase or safety-reviewed free text, profile text, countries chosen for display on the card, and display badges saved when the card was collected; anyone who knows the share URL can view that image. It does not include an exact place or time, exchange area, internal information identifying another user or the owner, or private card photos or notes. Orbitomo may make a page unavailable before expiration if a public card ends, content becomes unavailable, or a safety reason applies.

Opening a share page or creating a card from its call to action does not automatically create a friend, follow, contact, or Feed relationship with the person who shared it.

After sharing, the external service's terms and privacy policy apply to the content on that service.

9. Tomo Egg AI Creation

Tomo Egg AI creation uses text entered by a user to create colors, patterns, or parts for a Tomo Egg. The entered text is not a public post, and generated content cannot be equipped or shared until safety checks are complete.

Text entered for AI creation must not include:

• Contact details, external account names, addresses, school or workplace details, My ID, or exact locations
• Impersonation of a real person, personal face photos, or another person's likeness
• Sexual content, violence, hate, harassment, content inappropriate for minors, dangerous acts, or illegal acts
• QR codes, external links, or readable contact messages
• Material that infringes another person's rights

If creation fails, does not finish in time, or does not pass a safety check, the generated content is not provided and the Orbit Points intended for that creation are returned.

10. Paid Items, Points, And Subscriptions

Orbitomo may offer Founder Badge, Supporter Badge, Orbit Points, Shop exchanges, and Venue Partner subscriptions.

• Purchases are processed through Apple's in-app purchase system.
• Orbit Points can be used only for supported in-app features.
• Orbitomo does not provide random paid rewards, cash-out, user-to-user point transfers, resale, or ranking rewards.
• Refunds, restores, and purchase revocations follow Apple's processes.
• An approved Venue Partner may purchase a monthly subscription that increases the total number of approved Venue Cards it can publish from 2 through 10, depending on the selected plan.
• The Apple Account is charged when the purchase is confirmed. The subscription renews every month until canceled and can be changed or canceled through Apple's subscription management.
• A subscription does not remove the review, safety, or publication requirements for an individual Venue Card and does not guarantee advertising results, user visits, or permanent publication.
• Paid features, points, subscription content, prices, and availability may change.

Use of the iOS app is also subject to the Apple Standard EULA. These Terms describe conditions specific to Orbitomo and do not replace Apple's license terms.

11. Support

Users can contact support through the in-app support path or by emailing support@orbitomo.com.

Urgent physical danger, crime, medical emergencies, disasters, and urgent facility matters should be reported to police, fire services, medical services, facility staff, a guardian, a school, or another appropriate local authority instead of Orbitomo support.

12. Service Changes And Availability

Orbitomo may change, suspend, or end features, cards, public places, points, AI creation, Shop content, displays, prices, available regions, or available hours.

Features may be delayed or unavailable because of maintenance, failures, communication conditions, device settings, operating-system controls, permissions, Apple or other service-provider availability, or safety checks.

13. Intellectual Property

Rights in the Orbitomo name, logos, app, interface, images, text, software, data, Tomo Egg, Tomo Card, and other content provided by Orbitomo belong to Orbitomo or the relevant rights holder.

A user must have the necessary rights to any content the user submits and must not infringe another person's rights. The user permits Orbitomo to use submitted content as needed to provide the service, conduct safety reviews, display allowed content, store records, respond to support, comply with law, and improve quality.

14. Disclaimers

Orbitomo is provided as a card-collection game. To the extent permitted by law, Orbitomo does not guarantee the operating status, accuracy, safety, or crowding of a venue or Spot; third-party conduct; device or operating-system behavior; communication conditions; payment-service availability; AI output; or the continued availability of every feature.

Orbitomo does not provide medical, disaster-response, crime-prevention, emergency-reporting, guardian-monitoring, location-tracking, route-guidance, facility-safety, identity-verification, financial, or legal advice.

15. Enforcement

If Orbitomo detects or reasonably suspects a violation of these Terms, Orbitomo may hide or delete content, disable cards, restrict features, suspend an account, conduct a safety review, or correct point records as necessary.

For serious safety concerns, protection of minors, rights infringement, illegal conduct, abuse, payment fraud, or location misuse, Orbitomo may retain necessary records and respond to an appropriate authority.

16. Changes And Contact

Orbitomo may update these Terms when features or legal requirements change. Material changes may be announced in the app, on public pages, or by another reasonable method.
